1. Agreement
These Terms of Service ("Terms") form a binding agreement between CallForge Ltd ("CallForge") and the organisation or individual registering for an account ("Customer", "you"). By creating an account, using the platform, or executing an order, you accept these Terms.
If you accept on behalf of an organisation, you represent that you have authority to bind that organisation.
2. The service
CallForge provides cloud software for AI-assisted outbound calling, lead qualification, appointment booking, analytics, and related integrations. Features depend on your subscription plan and may change as we improve the product.
We grant you a non-exclusive, non-transferable right to use the service during your subscription term, subject to these Terms and fair use limits described in your plan.
3. Customer responsibilities
You are responsible for your users, lead data, campaign content, and compliance with applicable laws including UK GDPR, PECR, and industry-specific regulations.
- Obtain lawful bases and consents for outbound contact and call recording where required.
- Maintain accurate account and billing information.
- Not use the service for unlawful, harassing, or deceptive campaigns.
- Not attempt to reverse engineer, overload, or circumvent security controls.
4. Fees and payment
Subscription fees are billed as described on our Plans page or your order form. Self-serve Starter, Growth, and Scale subscriptions are processed through Stripe. Failed payments may result in suspension after reasonable notice.
Unless otherwise agreed, subscriptions renew automatically until cancelled. You can manage payment methods and invoices via Stripe where that portal is enabled for your account. Refunds are handled according to your plan and applicable consumer rights.
5. Data and intellectual property
You retain ownership of your lead data and campaign materials. You grant CallForge a licence to process that data solely to provide the service.
CallForge owns the platform, software, documentation, and branding. Feedback may be used to improve the service without obligation to you.
6. Confidentiality and security
Each party will protect the other's confidential information with reasonable care. Our security practices are described at /security and in the DPA where applicable.
7. Warranties and disclaimers
The service is provided "as is" except as expressly stated in an order form. We do not guarantee specific call outcomes, connect rates, or revenue results. AI-generated conversation quality may vary and should be monitored, especially during initial campaigns.
8. Limitation of liability
To the maximum extent permitted by law, CallForge is not liable for indirect, incidental, or consequential losses including lost profits or data. Our total liability arising from these Terms is capped at the fees paid by you in the twelve months before the claim, except where liability cannot be limited by law.
9. Term and termination
Either party may terminate for material breach if not cured within 30 days of notice. You may cancel renewal through account settings or by contacting support.
On termination we will make your data available for export for a limited period, then delete or anonymise it according to our retention policy and DPA.
10. Governing law
These Terms are governed by the laws of England and Wales. Courts in England have exclusive jurisdiction, without prejudice to mandatory consumer protections where applicable.
